Criminal Defence Marketing: Urgent Calls, Careful Words
Criminal defence work arrives at bad moments: an arrest late at night, a summons in the mail, a family member calling from a hallway. The firms that get these calls are the ones that answer, explain the next step and never exploit the fear.
Who searches for a criminal defence lawyer?
Three groups search: people who have just been charged or released, family members of someone in custody, and people with an upcoming court date who still have no lawyer. Many searches name the charge: impaired driving, assault, theft, drug offences.
The searcher is often not the client. Parents, spouses and friends call on behalf of someone who cannot, so ads and pages should speak to them too.
| Searcher | Typical search | What they need |
|---|---|---|
| Person just released with conditions | "criminal lawyer near me", "assault charge lawyer" | A consultation soon and what to do before court |
| Family member of someone in custody | "lawyer for bail hearing", "my son was arrested" | Someone who answers now and explains the process |
| Driver charged with impaired driving | "DUI lawyer", "impaired driving lawyer" | Fees, licence consequences, first court date |
| Person with a court date and no lawyer | "first appearance lawyer", "criminal lawyer cost" | Whether the firm can attend, and the cost |
Charge-specific pages win these searches. Each page should explain the charge in plain words, the usual steps and how the firm bills, without suggesting any outcome. The SEO page covers how to structure practice pages.
How should criminal defence firms handle after-hours calls?
Answer them, or do not advertise during those hours. Arrests happen at night and on weekends, and families search immediately. An after-hours ad that lands in voicemail wastes the click and leaves the family to call the next firm.
| Time | Phone coverage | Ads |
|---|---|---|
| Weekdays 8 a.m. to 6 p.m. | Office staff, lawyer available | All campaigns, call button on |
| Weekdays 6 p.m. to 11 p.m. | On-call lawyer by forwarding | Urgent campaign only, call button on |
| Overnight | Answering service takes details | Off, or page-only ads with a morning call back |
| Weekends | On-call lawyer by rotation | Urgent campaign only |
The intake page covers call scripts and response times, and the call and intake tracking page covers measuring which ads produce answered calls.
Can a criminal lawyer advertise bail help on Google Ads?
Yes, as legal representation. Google's policy on other restricted businesses has banned ads for bail bond services worldwide since 2018, but legal representation is not affected. A lawyer offering to represent someone at a bail hearing is offering legal services, not a bail bond.
ShoutEx view: keep the wording clearly about representation, for example "lawyer for bail hearings", and avoid phrases that read like a bond or payment service. Canada does not have the commercial bail bond industry the policy was written for, but ad reviewers apply the policy to the words they see.
- Write "Bail hearing representation" rather than "Bail help" or "Get out fast".
- Do not mention payment plans for bail amounts or anything that sounds like posting money.
- If an ad is disapproved, appeal with a note that the advertiser is a law firm offering representation.
- The same Google page says only certified governments and authorized providers may advertise direct acquisition of government documents and services. That matters more for immigration firms than for defence work.
Which fee models suit criminal defence marketing?
Criminal defence firms commonly use block or flat fees by stage, hourly billing for trials, and legal aid certificates for eligible clients. Fees by stage are easy to advertise because each stage is a defined piece of work.
| Fee model | Typical use | Marketing note |
|---|---|---|
| Flat fee by stage | Bail hearing, resolution, guilty plea, a short trial | Say exactly what each stage covers and whether taxes are extra |
| Block fee for the whole matter | Common summary charges, impaired driving | List what would take the matter outside the block |
| Hourly with retainer | Complex or lengthy trials, appeals | Explain the retainer and how billing is reported |
| Legal aid certificate | Eligible clients | Say whether you accept certificates; many families search for this |
If you publish fees, Ontario's rules expect fee advertising to be reasonably precise about what the fee covers and to say whether disbursements and taxes are extra. See marketing rules by province.
Promise a call back, never a result.
A defence ad can promise that a lawyer will call within the hour if that is true. It can never promise charges withdrawn, an acquittal or a win. The first builds trust; the second breaks the rules and the client relationship.
What does a compliant criminal defence ad look like?
A compliant defence ad says the firm is made up of lawyers, names the charges it handles and the area it serves, and offers a call or consultation. It does not promise a result, call the firm aggressive or claim it is better than other lawyers.
Charges dropped guaranteed or your money back. Expert DUI defence. Call now!
- "We win" and "charges dropped" promise outcomes and raise expectations
- "Aggressive" is named in Ontario's commentary as a possible breach
- "#1" and "expert" are superlative and specialist claims
- "Guaranteed" makes a promise no lawyer can keep
Criminal defence lawyers. Fees by stage explained. A lawyer calls back within the hour.
- Says "Lawyers" in the headline, as Ontario rule 4.2-1.1 requires
- Names the charge and the courthouse people are searching for
- Promises a call back, which the firm controls, not an outcome
- Mentions legal aid only if it is true

What should a criminal defence intake call cover?
Find out who is charged, with what, where and when the next court date is, and whether the person is in custody. Then offer a specific next step: a call from the lawyer, a meeting or attendance at court.
- Who is calling, and who is charged, if it is a different person.
- The charge, the courthouse and the next court date.
- Whether the person is in custody or released, and on what conditions.
- Whether they already have a lawyer. If they do, the firm should not encourage a switch; rule 4.1-2 bars marketing intended to do that.
- Names of any co-accused or complainants, for the conflict check.
- Whether they have or may qualify for a legal aid certificate.
- A safe number and time for the lawyer to call back.
Tell callers not to describe the facts of the allegation to intake staff or in voicemail. The lawyer will ask what is needed after the conflict check.
What should a criminal defence firm measure?
Measure answered calls, call backs within the target time, consultations and retainers by charge type and by hour of day. Hour-of-day data shows whether after-hours coverage is paying for itself.
| Time window | Calls | Answered live | Retained |
|---|---|---|---|
| 8 a.m. to 6 p.m. weekdays | 64 | 58 | 13 |
| 6 p.m. to 11 p.m. weekdays | 27 | 24 | 8 |
| Weekends | 19 | 15 | 5 |
| Overnight (answering service) | 11 | 11 | 2 |
| Total | 121 | 108 | 28 |
If evening calls retain at a higher rate than daytime calls, as in this example, the on-call rotation is likely worth its cost.
Frequently asked questions
How do criminal defence lawyers get clients?
Mostly from local search, Google Ads for charge-specific searches, the Google map listing and referrals. Answering calls fast, including evenings, makes the biggest difference.
Can criminal lawyers advertise on Google Ads?
Yes. Google bans bail bond service ads, not legal representation. Keep wording clearly about lawyers and representation.
Can a defence lawyer advertise "charges dropped" or "we win"?
No. Promising outcomes raises expectations, and Ontario's commentary treats such marketing as a likely breach. Describe services and process instead.
Can a criminal lawyer say aggressive defence?
Ontario's commentary names suggesting a lawyer is aggressive as marketing that may breach the rules. Choose other words.
Should a defence firm advertise after hours?
Only if someone answers. Run urgent ads in the hours you staff, and switch them off or to page-only ads otherwise.
Can I contact people after an arrest appears in the news?
No. Marketing that takes advantage of a person after a traumatic experience, or that amounts to harassment, breaches Ontario rule 4.1-2.
Should a defence firm list legal aid?
If it accepts legal aid certificates, yes. Many families search for it. Do not list it if you do not take certificates.
How should defence firms reply to reviews?
Without confirming the reviewer was a client or mentioning any charge. Confidentiality applies in public replies.
